TERMS OF USE

You must be at least 18 years of age (or the age of majority in Your jurisdiction) to use the Services, or use them only under the supervision of a parent or legal guardian who agrees to these Terms. If You use the Services on behalf of an organisation, You represent that You have authority to bind that organisation.

Boundary Breakers creates platforms and initiatives across sport, communities, culture and public programmes. The Services may include informational websites, contact forms, newsletters, and applications We publish under Our brand or Our intellectual properties.

We may update, suspend or discontinue any part of the Services at any time without liability, to the extent permitted by law.

Some app features may require an account. You are responsible for maintaining the confidentiality of Your login credentials and for all activity under Your account. Notify Us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

You agree not to:

• use the Services for any unlawful, harmful, fraudulent or abusive purpose;
• interfere with or disrupt the Services, servers or networks;
• attempt to gain unauthorised access to any systems or data;
• copy, reverse engineer, scrape or misuse Our content or software except as allowed by law;
• upload malware or content that infringes others' rights;
• misrepresent Your identity or affiliation; or
• use the Services in any way that violates Apple App Store Review Guidelines or other applicable platform rules when using Our apps.

All content, trademarks, logos, designs, text, graphics, software and other materials in the Services (including the Boundary Breakers name and marks) are owned by or licensed to Us and are protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal or authorised organisational purposes in accordance with these Terms. No other rights are granted.

If You submit content to Us (for example through a contact form or in-app feedback), You grant Us a non-exclusive, worldwide, royalty-free licence to use, store and process that content as needed to operate the Services and respond to You. You represent that You have the rights necessary to submit such content and that it does not violate any law or third-party rights.

If an app offers paid features or subscriptions through the Apple App Store, payment is processed by Apple. Pricing, billing, renewal and cancellation are governed by Apple's terms and the information shown at purchase. Refund requests for App Store purchases are generally handled by Apple in accordance with Apple's refund policies.

If You obtain an app from the Apple App Store, You acknowledge that:

• these Terms are between You and Boundary Breakers only, not with Apple;
• Apple has no obligation to provide maintenance or support for the app, except as required by applicable law;
• in the event of any failure of the app to conform to an applicable warranty, You may notify Apple and Apple may refund the purchase price (if any) to the extent required by its policies; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app;
• Apple is not responsible for addressing claims by You or any third party relating to the app or Your possession and use of it, including product liability, legal or regulatory claims, and consumer protection claims;
• in the event of a third-party claim that the app infringes intellectual property rights, We (not Apple) will be responsible for the investigation, defence, settlement and discharge of that claim as required by these Terms;
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to Your licence of the app, and upon Your acceptance of these Terms, Apple will have the right to enforce these Terms against You as a third-party beneficiary; and
• You represent that You are not located in a country subject to a U.S. Government embargo or designated as a 'terrorist supporting' country, and You are not listed on any U.S. Government list of prohibited or restricted parties.

The Services may link to or integrate third-party websites, apps or services. We are not responsible for their content, terms or privacy practices. Your use of third-party services is at Your own risk and subject to their terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the Services will be uninterrupted, error-free or completely secure.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Boundary Breakers Network LLP AND ITS PARTNERS, OFFICERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY.

Our total aggregate liability for any claim arising out of or relating to the Services shall not exceed the greater of (a) the amounts You paid Us for the Services in the twelve (12) months preceding the claim, or (b) INR 5,000, except where liability cannot be limited under applicable law.

You agree to indemnify and hold harmless Boundary Breakers Network LLP and its partners, officers, employees and agents from any claims, damages, losses or expenses (including reasonable legal fees) arising from Your misuse of the Services, Your content, or Your breach of these Terms.

We may suspend or terminate Your access to the Services at any time if You violate these Terms or if We discontinue the Services. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability and indemnity) will survive termination.

We may update these Terms from time to time by posting the revised version on this page and updating the "Last Updated" date. Continued use of the Services after changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of India. Courts in Mumbai, Maharashtra shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, subject to any mandatory consumer protections that apply to You.
